Inez Petersen and co-counsel Mark Perez have been litigating a cause of action under Washington's Distressed Property Conveyance Act for the better part of two years. The DPCA is a remedial statute designed to protect homeowners from foreclosure rescue scams. "It is an important consumer protection law steeped in the public interest. RCW 61.34.040 (“the legislature finds the practices covered by this chapter are matters vitally affecting the public interest”)."
We currently have a case in Division I Court of Appeals that involves issues of first impression in the interpretation of the statute. Yesterday, we were excited to learn that the Attorney General filed an amicus brief supporting our interpretation of key definitions within the Act that are sure to have far reaching consequences for Washington homeowners.
